Use of This Service Creates an Agreement

Litigation Regarding This Service
In the event of litigation, you agree and by the use of the Service submit to the exclusive personal jurisdiction of the appropriate courts of the State of Utah, either federal or state. The non-prevailing Party in such litigation shall pay the costs and expenses, including reasonable attorneys fees, incurred in arbitration or litigation, or in preparation therefore, by it and by the prevailing Party.

Prohibited Use of This Service

Conditions of Use for Personalized Information
CLINICAL OR MEMBER BENEFIT INFORMATION
In addition to the publicly accessible pages on intermountainhealthcare.org and selecthealth.org, there are sections on the site where password-protected, personalized content and functionality can be made available to registered users. Such sections include "My Health" and which make available to users who register for these services:

  • An online view of portions of their electronic Intermountain medical records
  • Secure online messaging with participating physicians and their office staffs
  • Access to personalized SelectHealth information

The entire Conditions of Use agreement and Intermountain's Notice of Privacy Practices also govern these personalized sections of intermountainhealthcare.org and selecthealth.org. In addition, the user of password-protected services ("PPS") on either intermountainhealthcare.org and selecthealth.org also agrees to the following provisions:

  • User is at least 18 years of age.
  • Intermountain has taken reasonable steps and has employed industry-standard practices and technology to ensure the integrity and confidentiality of this personally identifiable information; however, since even the most secure system can be violated, Intermountain cannot guarantee security.
  • Registration and use of a personally-identifiable password is a prerequisite to participating in PPS. User agrees to use good judgment in the selection of a password, agrees to not share this password with others, and understands that compromise of the user's password could allow personal information to become known to other parties.
  • If you feel your personal information has been compromised, contact our Online Services for assistance by calling (801) 442-5502 (Salt Lake area) or 1-800-442-5502 weekdays between 8:00 a.m. and 5:00 p.m.
  • Either the user, or Intermountain, may cancel participation in PPS at any time. Intermountain may be contacted at mypersinfo@intermountainmail.org to request cancellation.

In addition, each user of the password protected clinical services also agrees to the following provisions:

By agreeing to these terms and conditions, the user acknowledges that he/she is requesting access to portions of his/her health/insurance information and/or the ability to communicate with his/her Intermountain Healthcare team concerning his/her health information via the Internet using an electronic application called My Health.

  • User will only convey online messages of a non-urgent nature to his or her physician's office. Anticipated turnaround time for response to electronic messages is 1 to 2 business days. For emergencies, user will call 911 or the local EMS system.
  • User will only convey online messages that are suitable for communication in this medium. Some situations will be best handled either through a telephone conversation or an in-person visit.
  • Intermountain does not warrant that the user's online view of the user's personal health information represents the complete, legal medical record.
  • Secure messages exchanged between the user and participating physician offices become a part of the user's permanent medical record. This information is confidential, but may be typically released at user's request, or under legal requirement. User understands that when signing up for health insurance coverage, a release is generally signed, giving the insurance company permission to request enrollee's medical records.
  • User agrees to use appropriate discretion when sending online messages, particularly if the user does not want the information to appear in the permanent medical record.
  • Messages sent to the users Message Center might contain information that is important to the user's health and medical care. It is the user's responsibility to monitor these messages. The user is liable for any loss, injury or claims of any kind resulting from messages that the user fails to read in a timely manner.
  • All communication through My Health will be in regard to the users own health condition(s). The user agrees that asking for advice on behalf of another person could potentially be harmful and is a violation of the My Health terms of use.
  • To facilitate the delivery of care, any authorized person in the office of the user's physician or in the coverage group of the user's physician, may have access to the online messages exchanged between the user and the physician's office.
  • The user remains responsible for exercising reasonable judgment with the use of My Health. With all health concerns, the user is advised to consult directly with his/her personal physician or other healthcare provider when next steps are not clear.
  • User acknowledges that My Health may not be available all the time due to system failures, back-up procedures, maintenance, or other causes beyond the control of Intermountain. Access is provided on an "as-is, as-available" basis and Intermountain does not guarantee that the user will be able to access My Health at any particular time.
  • During times when My Health is unavailable, other communication methods (e.g., telephone) should be used to contact the personal physician or other healthcare provider.
  • Registered users may be contacted to be asked to complete or participate in patient satisfaction surveys regarding their use of My Health. Intermountain may analyze information submitted or obtained as part of descriptive (demographic) studies and reports. In such cases all of personal identifying information will be removed.

Conditions of Use for Personalized Information
BILLING AND ENROLLMENT FUNCTIONALITY FOR SELECTHEALTH'S HEALTHWEB
The billing and enrollment functionality is password-protected personalized content and functionality will only be made available to registered users. this site makes available to registered users the ability to perform the following transactions:

  • New Enrollment: Allows a new hire or new subscribers to enroll or be enrolled in plan coverage.
  • Open Enrollment: Allows existing subscribers to review and update their previously entered benefit selections and update other benefits during open enrollment period.
  • Member Maintenance: Allow updates to existing member information. A subscriber may update a dependent, update COB, change address, change personal information, and order an identification card.
  • Terminate Subscriber: Allows a subscriber and all of the subscriber's related dependents to be terminated by a health employer, group administrator or broker.

The user of billing and enrollment functionality password-protected services ("PPS")also agrees to the following provisions:

  • User is at least 18 years of age.

Intermountain may modify or change these Conditions of Use at any time. Such modifications or changes become effective immediately when they are posted to this Service. You agree to review these Conditions of Use frequently so that you will be familiar with them. You further agree that each time you use the Service you are, by such use, consenting to the Conditions of Use applicable at that time to the Service.
